These terms apply to buyers, sellers, and visitors of the Kaparay platform.

1. Who We Are

Kaparay is operated by Kaparay Limited, a company registered in England and Wales. We provide an online marketplace for users to buy and sell new and pre-owned South Asian clothing.

2. Account Registration

• You must be at least 16 years old to use the platform.
• You are responsible for maintaining the confidentiality of your login details.
• You agree to provide accurate, complete, and up-to-date information when registering.
• We reserve the right to suspend or terminate any account found to be in breach of these terms.

3. Buying on Kaparay

• When you purchase an item, you agree to pay the full price (including shipping and any fees).
• Payments are processed securely through third-party payment providers (e.g. Stripe, PayPal).
• Items are shipped by the seller or, in some cases, verified and shipped by Kaparay HQ.
• Buyers must confirm receipt to release payment to the seller.
• All purchases are subject to our Returns & Disputes Policy.

4. Selling on Kaparay

• Sellers must list only authentic, clean, and accurately described clothing.
• Kaparay reviews all listings before they go live. Approval is at our discretion.
• Sellers agree to ship items within the timeframe stated once sold.
• Commission fees apply and will be deducted before payout. (including shipping and any fees).
• Sellers are paid within 5 working days of buyer confirmation.
• High-value items (over £500) may require verification at Kaparay HQ before final delivery.
• Listings that are fraudulent, misleading, or inappropriate will be removed and may result in account suspension.

5. Listing Approval and Removal

• All listings are subject to review and approval by Kaparay.
• We may reject or remove listings that violate our policies, are counterfeit, or are unsafe.
• Kaparay reserves the right to delist or suspend sellers at our sole discretion.

6. Returns & Disputes

• Return requests must be submitted within 3 days of receiving the item.
• Buyers may be asked to provide images and an explanation.
• Kaparay will review each dispute fairly and may issue refunds at our discretion.
• Sellers are expected to cooperate in dispute resolutions.

7. Prohibited Activities

You agree not to:

• List counterfeit or prohibited items
• Impersonate other users or brands
• Use the platform for fraud or scams
• Circumvent commission or fee systems
• Upload harmful or malicious content

Violation may result in immediate account suspension and legal action.

8. Platform Availability

• We aim to ensure the Platform is available 24/7, but we do not guarantee uninterrupted service.
• We may need to suspend the site temporarily for maintenance or updates.

9. Intellectual Property

All content on Kaparay, including logos, branding, images, and software, is the property of Kaparay Limited and protected under UK intellectual property laws. You may not copy or reproduce any content without permission.

10. Limitation of Liability

Kaparay is a marketplace platform. We do not own or inspect the items sold by users. We are not responsible for:

• Quality or condition of items
• Delays or damages during shipping
• User interactions off-platform

We are not liable for any indirect or consequential damages.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the UK courts.

12. Changes to Terms

We may update these Terms from time to time. Users will be notified of major changes, and continued use of the platform constitutes acceptance of the updated Terms.
